Job Summary:

The Manager of Dispute Resolution and ER Processes is an integral part of the Policy, Privacy and Governance Community of Expertise, manages key employee-related programs including the Company’s Employee Dispute Resolution Program (EDRP) and the reasonable accommodations process, and is considered a Subject Matter Expert (SME) in the managed areas inclusive of extensive experience managing ER Processes.

The successful candidate will partner closely with the R&C People Operations Delivery Manager to develop and implement a Global ER Strategy inclusive of the identified ER programs above, investigate concerns raised through the EDRP and seek to bring the concerns to successful closure and resolution. Work closely with Legal and People Operations ER Teams to ensure that both EDRP and ER investigations are conducted according to established rules and principles, and that all individuals involved are treated fairly. The successful candidate will also manage and implement the company’s reasonable accommodation policy, manage relationships with vendors engaged to facilitate compliance with Bechtel’s policies and programs, and raise awareness of related legal and policy requirements through regular communication and training of ER/HR professionals and managers. #LI-Hybrid #LI-HB1

Major Responsibilities:

  • Partner with the People Operations Region & Country Manager to ensure regional ER teams receive proper training in ER matters where gaps are identified

  • Effectively manage the EDRP and ensure that investigations are carried out in compliance with applicable company policies and local, state, and federal employment laws and regulations. Suggest areas for improvement for EDRP

  • Receive and respond to incoming employee relations questions, concerns, and issues presented through the EDRP or via other HR channels. Engage with complainants, prepare and implement investigation plans, conduct interviews, review data/documents, prepare investigation reports, communicate findings, solicit counsel, and implement resolutions

  • Conduct thorough investigations of all claims submitted through the EDRP (and, at times, outside the EDRP if requested), act as a neutral party in the investigation and prepare formal, written findings and conclusions of investigations and recommendations for remedial action, when appropriate. Assess situations and implement, where appropriate, interim measures to ensure the safety and well-being of involved parties

  • By partnering with People Operations, propose and champion new and revised policies and programs to balance the needs of legal compliance, HR practice, governance, and business priorities with regard to management of the EDRP& ER Discipline

  • Provide accurate and comprehensive reports and responses to inquiries and assist with development and implementation of the EDRP including managing associated records, analysis, and reports

  • Willingness and ability to serve as the SME with regard to the Company’s policy and processes related to requests for reasonable accommodations based on disability and religion

  • Partner with Legal, ER and ER People Operations to draft, develop, update as needed, policy, guidelines, processes, forms/tools required for successful implementation of the reasonable accommodations process

  • Acting as an SME provide general information and interpretations of applicable policies, rules, processes, and procedures as these relate to ER, EDRP and reasonable accommodations processes

  • Collaborate with Legal to analyze complaints, and where applicable, partner on investigations in accordance with Company policies and procedures Analyze data, compile statistical reports, and present program results as necessary or upon request

  • Liaise and consult with Legal, business managers, and regional experts to ensure that issues are consistently addressed in a fair manner and elevated to proper senior management as appropriate

  • Perform other duties as assigned

Education and Experience Requirements:

Requires bachelor's or master's degree (or international equivalent) and 13-15 years of relevant experience or 17-19 years of relevant work experience

Required Knowledge and Skills:

  • Thorough knowledge of the reasonable accommodations process required by the Americans with Disabilities Act and Title VII or ability and willingness to quickly gain expertise in these areas

  • Excellent written and oral communication skills

  • Professional work ethic and good judgment

  • Demonstrate good judgment, discretion, and a willingness to learn and gain expertise in assigned areas

  • Demonstrated ability to effectively oversee, challenge, and develop investigative teams.

  • Keep abreast of legal developments related to ER inclusive of reasonable accommodations obligations and processes

  • Ability to confidently develop and express contrasting points of view with both senior management, peers and employees

  • Experience establishing or transforming EDRP strategies and programs

  • Significant experience in a range of challenging Employee Relations matters

  • Stay abreast of ER best practices and trends regarding the EDRP, reasonable accommodations and investigations

  • Experience providing training to Human Resource Professionals and managers

  • EPC Industry experience is a preferred
